This Acceptable Use Policy governs the proper use of Bizzfo platforms, systems, APIs, websites, applications, and related services. Users must use the Services lawfully, responsibly, and respectfully at all times. Violations of this policy may result in suspension, termination, or legal action.
Purpose
This Acceptable Use Policy ("AUP") sets out the rules and guidelines that govern how users may access and use the Services provided by Bizzfo (Pty) Ltd. The purpose of this AUP is to protect the integrity, security, and availability of the Services for all users, and to ensure that the Services are used in a lawful and responsible manner.
Marketing Compliance
Users are responsible for ensuring that all marketing communications sent using the Services comply with applicable laws and regulations, including POPIA, consumer protection laws, anti-spam regulations, and communication platform policies. Users must obtain all required consents before sending marketing communications.
Fair Resource Usage
Users may not use the Services in a manner that excessively consumes infrastructure resources, negatively impacts platform stability, degrades service quality for other users, or creates unreasonable operational load. Bizzfo reserves the right to apply usage limitations, throttling, suspensions, or restrictions where reasonably necessary to maintain platform stability and security.
Prohibited Activities
Users may not use the Services for any of the following activities:
The following activities are strictly prohibited and may result in immediate suspension of access and referral to law enforcement authorities.
- Using the Services unlawfully or in violation of any applicable laws or regulations
- Committing fraud, misrepresentation, or engaging in deceptive practices
- Distributing malware, viruses, ransomware, spyware, or other harmful code
- Interfering with or disrupting system operations, servers, or networks
- Attempting to gain unauthorised access to systems, accounts, or data
- Bypassing or circumventing authentication or security measures
- Overloading, flooding, or causing excessive load on infrastructure
- Scraping, harvesting, or extracting data without written permission
- Impersonating other users, employees, or organisations
- Distributing spam, unsolicited communications, or bulk messages
- Using the Services to infringe intellectual property or other rights
- Uploading, transmitting, or storing unlawful, abusive, defamatory, or harmful content
API Usage Restrictions
Where API access is provided to users:
- API credentials and access tokens must remain strictly confidential
- Rate limits and usage quotas must be respected at all times
- Abusive or excessive automated requests are prohibited
- Unauthorised data scraping or extraction via API is prohibited
- API access may be suspended or terminated for misuse without prior notice
Integration with third-party systems via Bizzfo APIs remains subject to these restrictions. Users are responsible for ensuring that their integrations comply with this AUP.
Messaging & Communication Platforms
Users may not use Bizzfo messaging systems, WhatsApp integrations, SMS systems, or communication platforms to:
- Send spam or unsolicited bulk communications
- Send unlawful marketing without required consents
- Harass, threaten, or intimidate users or third parties
- Distribute malicious links, phishing content, or harmful material
- Impersonate businesses, individuals, or Bizzfo personnel
Users remain responsible for obtaining all required marketing consents before sending communications through the Services, in compliance with POPIA and applicable South African law.
Security
Users must not:
- Attempt to probe, scan, or test the vulnerability of any Bizzfo system
- Perform penetration testing or load testing without prior written authorisation
- Interfere with the security or integrity of any infrastructure
- Access or attempt to access data belonging to other users
- Introduce any form of malicious code or security exploit
Any unauthorised access attempts or security-related incidents may be reported to the South African Police Service and relevant cybercrime authorities. Unauthorised access to computer systems constitutes a criminal offence under South African law.
Fair Usage
To ensure reliable, consistent service for all users, Bizzfo reserves the right to:
- Monitor usage patterns and system activity
- Apply rate limiting to API calls and system requests
- Suspend or throttle accounts generating excessive usage
- Protect infrastructure stability and performance for all users
Bizzfo may contact users whose usage patterns indicate abnormal activity or potential policy violations.
User Responsibility
Users remain solely responsible for:
- Compliance with all applicable laws and regulations
- The accuracy and legality of information submitted through the Services
- All activities performed under their accounts
- Safeguarding login credentials and access tokens
- Obtaining required consents for marketing and communications
- The conduct of their employees, agents, and contractors using the Services
Enforcement
In response to violations of this AUP, Bizzfo may:
- Suspend or terminate user accounts without prior notice
- Restrict or limit access to specific features or Services
- Investigate suspected misuse or unlawful activity
- Report unlawful conduct to relevant authorities
- Pursue civil or criminal remedies where appropriate
Bizzfo's failure to enforce any provision of this AUP on any occasion does not constitute a waiver of Bizzfo's right to enforce the same or other provisions in future.
Changes to this Policy
Bizzfo may update this Acceptable Use Policy from time to time. Updated versions will be published on our websites and platforms. Continued use of the Services after changes become effective constitutes acceptance of the updated policy.
